The Clarity Wireless Trade-In Program allows you to exchange your device(s) for a specified credit, as calculated by Clarity Wireless, which will be applied to your Clarity Wireless bill within sixty (60) calendar days of Clarity Wireless receipt of the device(s). Once you deliver the device(s) to Clarity Wireless authorized representative, the device(s) becomes the property of Clarity Wireless or any other individual or entity Clarity Wireless may choose, and the device(s) will not be returned to you under any circumstances. The Trade-In Program does not release you from any other obligations you have related to the device(s), including, but not limited to, any payment plan, service agreement, or any other agreement related to the device(s), and you shall remain solely responsible for those obligations. A device for which any amount is still owed under a phone financing plan is not eligible for trade-in, and for purposes of this policy you are not authorized to transfer ownership of such device.
The device traded in must be in the same condition as it was in at the time you first purchased it, except for normal and reasonable wear and tear as determined by Clarity Wireless in the exercise of its sole judgment and discretion ("Acceptable Condition"). If Clarity Wireless determines the device is not in Acceptable Condition at the time you deliver it: (1) Clarity Wireless will not issue any credit to you and has no obligation to return the device to you; and (2) you must immediately pay to Clarity Wireless the full remaining amount owed on that device.
Once you deliver the device to Clarity Wireless authorized representative, the device becomes the property of Clarity Wireless, and the device will not be returned to you under any circumstances. You represent and warrant that you are authorized to transfer ownership of the device, and that the device is not lost or stolen and has no outstanding liens or third party claims and is not subject to any security interest(s) granted in favor of any individual or entity. In the event that the device is determined to be lost or stolen property, or that you are not authorized to transfer ownership of the device: (1) Clarity Wireless will not issue any credit to you and has no obligation to return the device to you; and (2) you must immediately pay to Clarity Wireless the full remaining amount owed on that device; and (3) Clarity Wireless reserves the right to charge you for any loss incurred by Clarity Wireless related to the device.
You are responsible for deleting all content from your device before delivering the device to Clarity Wireless, and for retaining any accessories associated with that device, including, but not limited to, any SD and SIM cards. Content on a device that is delivered to Clarity Wireless will not be recovered for you, and accessories will not be returned. Clarity Wireless encourages you to erase all content on the device and perform a factory reset on the device prior to delivering it to Clarity Wireless authorized representative. CLARITY WIRELESS IS NOT RESPONSIBLE FOR REMOVING ANY PERSONAL, CONFIDENTIAL, AND/OR SENSITIVE INFORMATION OR CONTENT FROM YOUR MOBILE HANDSET, AND CLARITY WIRELESS DOES NOT GUARANTEE THAT PERSONAL, CONFIDENTIAL, AND/OR SENSITIVE INFORMATION OR CONTENT ON YOUR DEVICE WILL BE DELETED OR UNRECOVERABLE.
TO THE EXTENT PERMITTED BY LAW, CLARITY WIRELESS AND ITS EMPLOYEES, OFFICERS, DIRECTORS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY AMOUNT IN EXCESS OF THE SPECIFIED CREDIT. IN NO EVENT WILL CLARITY WIRELESS AND/OR ITS EMPLOYEES, OFFICERS, DIRECTORS, MEMBERS, AND AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, INCIDENT, OR EXEMPLARY DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, EVEN IF CLARITY WIRELESS IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF ANY TRADE-IN OF YOUR DEVICE(S).
