TECHNOLOGIES USED IN INTERNET SERVICE

Clarity Wireless provides mobile wireless telecommunications and Broadband Internet access services using several 3G and 4G cellular technologies. The expected speeds of these services are detailed below. Each of our services is suitable for some real-time applications, including web surfing, voice over IP, navigation, and music. 4G service is suitable for movies, gaming, and other applications that demand a high bandwidth connection. The faster the service you subscribe to and can access at a given location, the better an application will perform. Occasionally, at times of peak usage, some applications may run more slowly than usual.

SERVICE PLAN PRICES

Clarity Wireless offers a number of service plans providing for Internet access. All plans have data usage allowances. If you exceed your allowance in a billing period, your access speeds may be slowed or you may be charged an additional amount for your excess usage. NETWORK MANAGEMENT

Generally, Clarity Wireless does not inhibit the ability of our customers to use our wireless services. However, like many service providers, Clarity Wireless employs reasonable network system management practices consistent with industry standards to maintain the reliability of its network and to minimize network issues and complications. Specifically, Clarity Wireless manages its network in the following ways:

  • Traffic identified as malicious (such as distributed denial of service attacks) may be automatically identified and blocked by Clarity Wireless firewalls.

  • In the event of network congestion in which the supporting technology determines that voice or video quality is likely to be degraded for customers, Clarity Wireless supporting technology may automatically manage its network resources to prioritize Voice and Video Calling Over LTE ("VoLTE") communications in order to avoid disruption of those services. Except for VoLTE, network management is non-discriminatory and agnostic to the application.

  • Certain services are subject to limitations, detailed below.

DATA SPEED LIMITATIONS

Clarity Wireless data and Internet services are subject to speed limitations, which are determined by the Customer's service plan and the type of service being used. These data speed limitations are protocol and service-agnostic and are applied automatically upon the creation of the account of the customer and if a customer reaches the data allowance of their plan. As of the effective date of this policy, Clarity Wireless data speed limitations are as follows:

Mobile Hotspot Device 4G LTE

  • Essential  – up to 120 Mbps download; up to 120 Mbps upload; up to 512 Kbps download and upload after monthly data threshold is reached

4G LTE managed by Clarity Wireless (used for fixed 4G LTE services)

  • Up to 120 MBPS download; up to 120 MBPS upload; up to 512Kbps download and upload after monthly data threshold is reached

Home Internet Plans

Home Internet service plans are subject to data speed reductions at a certain level of 4G usage based on service plan. All data usage above the applicable “Essential” or “Unlimited” 4G data allotment described herein shall be provided at speeds up to 512kbps.  “Unlimited Home Advantage” 4G data allotment described herein shall be provided at speeds up to 120Mbps. “Unlimited Advantage” monthly 4G data allotment: no data limit. As the plan is unlimited  If Clarity wireless deems abuse we reserve the right to cancel service. (Abuse policy more than 600GB back to back)  “Essential” monthly 4G data allotment: 100GB. 

 

Cellular Phone Data Plans

"Essential," "Unlimited," "(Plans $15-$60)– Data Only,” "By the Gig," "Overage Protection, " and "Prepaid, Expanded" data plans are subject to data speed reductions at a certain level of 4G (up to 8mpbs) usage based on service plan. All data usage above the applicable “Essential,” “Unlimited,” “Business Unlimited – Data Only," or "By the Gig" 4G data allotment described herein shall be provided at speeds up to .1mbps. All data usage above the applicable “Unlimited Advantage” 4G data allotment described herein shall be provided at speeds up to 400kbps.

“ Unlimited Advance” monthly 4G data allotment: . “Unlimited” monthly 4G data allotment: 50GB per line. “Business Unlimited – Data Only” monthly 4G data allotment: 100GB per line. “Unlimited Advantage” monthly 4G data allotment: 100GB per line.

All data usage above the data allotment associated with Customer's "Overage Protection" or "Prepaid Expanded" data plan (as set forth on the Customer Service Agreement) shall be provided at up to 2G speeds.

ROAMING DATA LIMITATIONS

Clarity Wireless relies on partner companies to provide wireless data services outside of its home service territory. For this reason, the following limitations apply to data usage outside of Clarity Wireless home service territory for all service plans including the “unlimited” plans described below:

  • 10 GB monthly average per service line, calculated over any 2 consecutive months; or

  • 30% of all data usage on an account during any 2 consecutive months

In the event your data usage outside of Clarity Wireless home service territory exceeds the limitations set forth above, you may incur additional overage or roaming charges, and Clarity Wireless may, without notice, at its sole discretion and in addition to all other remedies available to it, suspend, limit, or terminate the account or service line associated with the excess usage, or change the account or service line to another plan for data services. The change is accepted upon use of the service after the change takes effect.

PROHIBITED ACTIVITIES

In furtherance of the goal of providing and maintaining high-quality services throughout our coverage areas, Clarity Wireless prohibits any use of any of its network or services, or any associated Third Party Service, in a manner that Clarity Wireless, in its sole and absolute discretion, determines violates the customer agreement Terms and Conditions, does or could damage or interfere with Clarity Wireless network or other networks, or does or could harm Clarity Wireless or a third party.

Any such prohibited use shall be a breach of this policy and your customer agreement Terms and Conditions.

In such circumstances, our Customer Service Department will, when reasonably possible, contact Customer directly and explain Clarity Wireless network management practices, the limits of Customer's data plan package(s), and the right of Clarity Wireless to disconnect data services in their entirety if Customer's abuse of the data connection continues.

APPROVED EQUIPMENT

All phones and devices connecting a customer to the network must either be (i) provided by Clarity Wireless, (ii) approved for use by Clarity Wireless or (iii) provided by an existing and approved wireless data roaming partner working with Clarity Wireless. You can find information concerning the devices currently approved for use on the network at Clarity Wireless retail website, . The Company is not responsible for the compatibility, suitability or functionality of any equipment that is provided by the customer or any third party. If any such equipment harms our network or degrades the service of other users, the customer may be required to disconnect the device and, in some cases, we may suspend or terminate service to customers that in our sole judgment are causing or contributing to harm.

PRIVACY AND SECURITY

Clarity Wireless maintains a privacy policy, which can be found here on our website . As discussed in the privacy policy, we may monitor your usage in an effort to protect network integrity and security, ensure quality control, and to prevent misuse of Clarity Wireless network. We may suspend or terminate service to customers that in our sole judgment harm the network or other users. Note that Clarity Wireless is not responsible for the information, content, applications or services provided by others. Before you access, use, link to or download any service or application on your computer or wireless device, you should review the associated terms of service and privacy policy. We also recommend that all customers install, use, and keep up to date applications to protect their devices from viruses and malware.

Plans and features available to Clarity Wireless customers, messaging and data connection options and pricing (including pricing for exceeding data package plan access and use) .
